Spouse & Family Visas

What is the minimum income requirement for a spouse visa?

The minimum income requirement is currently £29,000 per year for couples without children. This increases by £3,800 for the first child and £2,400 for each additional child. Income can come from employment, self-employment, pension, or certain other sources.

How long does a spouse visa last?

An initial spouse visa is granted for 33 months. After this, you can apply for a 30-month extension. After 5 years total, you may be eligible to apply for Indefinite Leave to Remain (settlement).

Can I work on a spouse visa?

Yes, spouse visa holders have unrestricted right to work in the UK. There are no restrictions on the type of employment or hours you can work.

Skilled Worker Visas

What is the minimum salary for a Skilled Worker visa?
The general minimum salary is £38,700 per year or the 'going rate' for your occupation, whichever is higher. Lower thresholds may apply for shortage occupations, new entrants, or those with a PhD.
How long can I stay on a Skilled Worker visa?
A Skilled Worker visa can be granted for up to 5 years at a time. You can keep extending it as long as you meet the requirements. After 5 years continuous residence, you may apply for settlement.
Can my family join me on a Skilled Worker visa?
Yes, your partner and children under 18 can apply as your dependants. They'll have the same visa duration as you and can work or study in the UK.

Student Visas

Can I work on a Student visa?
Yes, but with restrictions. During term time, you can work up to 20 hours per week. During holidays, you can work full-time. Your CAS will confirm your work entitlement.
Can I switch to a work visa after graduating?
Yes, you can apply for a Graduate visa (2 years, or 3 years for PhD graduates) without a job offer, or switch directly to a Skilled Worker visa if you have a sponsored job offer.
How much money do I need to show for a Student visa?
You need to show you can support yourself: £1,334 per month (for up to 9 months) for courses in London, or £1,023 per month outside London, plus your course fees for the first year.

Immigration Appeals

How long do I have to appeal a visa refusal?
For in-country appeals, you typically have 14 days from receiving the decision. For out-of-country appeals, it's 28 days. Some decisions have different deadlines, so check your refusal notice carefully.
What is an Administrative Review?
Administrative Review is not an appeal. It's a request for the Home Office to reconsider a decision if there was a case working error. You have 14 days to apply and must identify a specific error.
Can I stay in the UK while my appeal is pending?
If you had valid leave when you appealed and appealed within time, you'll have 'Section 3C leave' allowing you to stay in the UK until your appeal is determined.
